OMNIDIAN PRIVACY POLICY

This Privacy Policy describes how Omnidian, Inc. and its subsidiaries and affiliated companies (including Omnidian Australia Pty Ltd, Solar Service Guys Pty Ltd, and Omnidian Home Protection Company of California, Inc.) (collectively, “Omnidian,” “we,” or “us“) collect, use, disclose, and otherwise process information about you, including our residential customers and the business contacts we engage with. The Omnidian entity responsible for your personal information depends on your location: Omnidian, Inc. for residents of the United States, and Solar Service Guys Pty Ltd or Omnidian Australia Pty Ltd (as applicable, depending on which entity you contracted with or which provides services to you) for residents of Australia. If you are unsure which entity applies to you, please contact us using the details in the Contact Us section below.

This Privacy Policy applies to information we collect (1) through our websites, our online portals, and any other of our online products and services (collectively, our “Services“); (2) in connection with the services we provide for customers of our solar and battery storage equipment (“Equipment“); and (3) when you otherwise interact with us, such as through our customer support channels or on social media. We may provide different or additional notices of our privacy practices for certain offerings, in which case those notices will supplement or replace the disclosures in this Privacy Policy.

This Privacy Policy does not apply to job applicants or workforce members of Omnidian, whose information is addressed in our Workforce Candidate Privacy Notice (and, for California-based candidates, our California Workforce Candidate Privacy Notice).

Additionally, our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

COLLECTION OF INFORMATION

The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you create an account, make a purchase, fill out a form, request services for your Equipment, communicate with us about your account or a service issue, schedule or confirm a site visit, sign up to receive marketing communications, request customer support, or otherwise communicate with us. The types of information we collect directly from you include your name, postal address, system location (address), email address, telephone number, business affiliation (where applicable), and any other information you choose to provide. If you make a payment to us or we process payments on your behalf, we work with third-party payment processors to process your payment method information.

Information We Collect Automatically

We automatically collect certain information about you as follows:

  • Services Information: When we provide services in connection with your Equipment, we collect information about the services performed, including service request and response details, work order information, maintenance and repair reports, photographs of Equipment and installation, monitoring alerts (including connectivity alerts, shading or soiling alerts, hardware issues, system performance, energy production and consumption data and other monitoring data relating to the performance and status of your Equipment), and home access information (such as gate or access codes) to facilitate site visits. This information may be collected directly by Omnidian or by its service providers (e.g., installers or repair and maintenance technicians) on behalf of Omnidian.
  • Device, Usage, and Activity Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, browser type, and unique device identifiers. We also collect information about the route by which you access our Services, access dates and times, and your activity on our Services, such as pages viewed and links clicked.
  • Audio Recordings and Chat Content: If you contact our customer support team through our chat feature or by phone, we may record, monitor, and retain those communications, including through call-recording, call-summarization, and other automated or AI-assisted tools provided by our vendors.
  • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies and pixels, to collect information about your interactions with the Services and our marketing communications. These technologies help us improve our Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Services are popular and count visits. Information We Collect from Other Sources

We obtain information from other sources. For example, we receive customer and Equipment information from commercial clients (such as solar retailers, equipment manufacturers, and other businesses that engage Omnidian to monitor or service Equipment) (collectively, “Commercial Clients“), including the end-customer name, address, telephone number, email address, and Equipment details (hardware, configuration, warranty, and similar information). We also receive contact information from referral sources, marketing service providers, and identity-verification or business-data providers.

Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may infer your approximate location based on your IP address or generate insights about service trends and Equipment performance based on monitoring data we collect.

USE OF INFORMATION

We use the information we collect to:

  • Provide, maintain, and support our Services and the services we provide for the Equipment;
  • Improve our Services and Equipment services, including by analyzing Equipment performance and supporting our customer-support and field-service operations;
  • Monitor and analyze trends, usage, and activities in connection with our Services and the Equipment;
  • Develop new products, features, and services (including new monitoring capabilities for PV and battery storage systems);
  • Personalize and contextualize your experience with our Services and marketing communications;
  • Send you technical notices, security alerts, system performance and service updates, support messages, and other transactional or relationship messages, including via SMS/text (see Your Choices section below on how to opt-out of SMS/text);
  • Send you marketing and promotional communications about Omnidian’s Services (see the Your Choices section below for information about how to opt out of these communications at any time);
  • Target advertisements about Omnidian’s Services to you on third-party platforms and websites (for more information and to opt out, see the Targeted Advertising and Analytics section below);
  • Detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of Omnidian and others;
  • Comply with our legal and financial obligations; and
  • Create de-identified and aggregate data that cannot reasonably be linked to you.

TARGETED ADVERTISING AND ANALYTICS

We engage others to provide analytics services, serve advertisements, and perform related services across the web. To do this, Omnidian and these third parties may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our Services and marketing communications as well as through other websites and online services. The information collected includes your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages, links clicked, and conversion information. This information is used to deliver advertising to you on other websites and online services, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand your activity. You can opt out of ad targeting through cookies and similar technologies on our website by following the prompts behind the Your Privacy Choices link in the site footer or by adjusting your preferences in our cookie consent management tool.

The activities described in this section may constitute “targeted advertising,” “sharing,” or “selling” under certain privacy laws. See the Additional Information for Specific Jurisdictions section below for details.

You can also learn more about interest-based ads, or opt out of having your web browsing information used for behavioral advertising purposes by companies that participate in the opt-outs made available by the Digital Advertising Alliance, by visiting www.aboutads.info/choices. Your mobile device should also include a feature that allows you to opt out of having certain information collected through mobile apps for behavioral advertising purposes.

DISCLOSURE OF INFORMATION

We disclose information about you as described in the Targeted Advertising and Analytics section above and in the following scenarios:

  • Vendors. We make personal information available to service providers, vendors, contractors, and consultants we engage to perform services for us or for you, including field installation, repair, and maintenance of Equipment; cloud hosting and IT infrastructure; customer support; payment and billing; professional services; and analytics, marketing, and advertising.
  • AU Third-Party Sales Partners. In Australia, we may exchange customer contact details and sales information with third-party sales partners in connection with referral or reseller arrangements.
  • Commercial Clients. If you become a customer of ours by first onboarding through a Commercial Client, we disclose information back to that Commercial Client about the Equipment services we provide, including case and work-order information, performance data, system metadata, and quotes. Please refer to the privacy policy of those Commercial Clients for details regarding their privacy practices.
  • Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • To Protect the Rights of Omnidian and Others. We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Omnidian, our users, the public, or others.
  • Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • Corporate Affiliates. Personal information is disclosed between and among Omnidian, Inc. and our parents, affiliates, and subsidiaries, including Omnidian Australia Pty Ltd, Solar Service Guys Pty Ltd, and Omnidian Home Protection Company of California, Inc., for the purposes described in this Privacy Policy.
  • With Your Consent or at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

Cookies and Similar Tracking Technologies

Omnidian uses cookies and similar tracking technologies, as described above. You can usually adjust your browser settings to remove or reject browser cookies. You can also adjust your cookie preferences using our Cookie Settings Center. Please note that removing or rejecting cookies could affect some of the functionality of our Services.

Communications Preferences

You may opt out of receiving promotional emails from Omnidian by following the unsubscribe instructions near the bottom of the email or by emailing us at [email protected]. If you opt out, we may still send you non-promotional emails, such as service alerts, account notifications, system performance updates, and similar communications. You also may opt out of automated text messages from us at any time by replying “STOP” or any alternative keyword we have shared with you.

ADDITIONAL INFORMATION FOR SPECIFIC JURISDICTIONS

Individuals Residing in Certain U.S. States

Some U.S. states have enacted privacy laws that grant their residents certain rights and require specific disclosures (“State Privacy Laws“). We generally do not collect information that is considered “sensitive” under State Privacy Laws, and we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.

As described in the Collection of Information section above, we collect personal information from various sources, including directly from you, automatically when you access or use our Services, and from third-party sources.

Data Retention

We store personal information for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy, including to comply with our legal obligations, resolve disputes, and enforce our agreements.

Sales, Sharing, and Targeted Advertising Activities

We disclose certain categories of personal information to show you targeted ads on third-party websites and online services and expand the reach and effectiveness of our own marketing campaigns. These disclosures may be considered “sales,” “sharing,” or use of personal information for “targeted advertising” under State Privacy Laws, and the table below covers the categories of personal information we disclose for these purposes and the categories of third parties that receive it.

Your Rights under State Privacy Laws

Opt Out of Sales, Sharing, and Targeted Advertising

You may opt out of activities that we engage in that constitute “sales,” “sharing,” or “targeted advertising” under the State Privacy Laws by:

  • Cookies and Similar Technologies: Following the prompts behind the Your Privacy Choices link in the footer of our websites, or by adjusting your preferences in our Cookie Settings Center. Your opt-out choice will be linked to your browser only; therefore, you will need to renew your opt-out choice if you visit our website from a new device or browser, or if you clear your browser’s cookies.

You can also opt out by visiting our websites with a legally recognized universal opt-out signal enabled, such as the Global Privacy Control. Our processing of the signal will be limited to cookie-based sales, sharing, and targeted advertising for the specific browser or device that you are using.

Access, Correction, and Deletion

You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. Residents of Connecticut, Minnesota, and Oregon may request a list of third parties to whom we have disclosed personal data (for clarity, that would exclude service providers/processors acting on our behalf).

To authenticate your request, we will ask you to provide information that we can match against information in our records, which may include first and last name, phone number, email, and street address. We may at times request additional information depending on the nature and sensitivity of your request.

Nondiscrimination

We will not discriminate against you for exercising your privacy rights.

Appeals

If we deny your request, you may appeal our decision by emailing us at [email protected] with the subject line “Privacy Rights Appeal.” If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

Authorized Agents

If you are an authorized agent seeking to make a request to opt out of sales, sharing, or targeted advertising on behalf of a consumer, please submit the request using the Your Privacy Choices footer link or email [email protected].

If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify such individual’s identity or confirm that the authorized agent has permission to submit the request. International Transfers

Omnidian operates internationally and we transfer personal information across borders to support our Services. Personal information about residents of Australia may be transferred to and processed in the United States, and personal information about residents of the United States may be transferred to and processed in Australia and Costa Rica (Costa Rica is currently used only for personal information about U.S. residents and not for personal information about Australian residents). When we make these international transfers, we take steps to ensure that your personal information receives an adequate level of protection, including through contractual safeguards with our affiliates and our Service Providers, vendors, and other recipients.

Sensitive Information

We do not seek to collect sensitive information (as defined in the Privacy Act, including information about racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, health or genetic information, or criminal record) from Australian residents and would only do so with your consent or where required or authorized by law.

Overseas Disclosure

As described in the International Transfers section above, personal information about Australian residents may be transferred to, or accessed by, our affiliates and Service Providers in the United States.

Automated Decisions

We use automated and AI-assisted tools to support our customer service and field operations, including call summarization, case analysis, and the prioritization of support requests. These tools assist our support team but do not replace human decision-making on matters that materially affect your service relationship.

Access and Correction

You may request access to, or correction of, the personal information we hold about you, subject to certain exceptions under the Privacy Act, by contacting us using the details in the Contact Us section below. We may require verification of your identity before releasing or correcting personal information. We will not charge a fee for making an access request, but may charge a reasonable administrative fee for providing copies.
